Voluntary Release, Assumption of Risk and Indemnity Agreement For and in consideration of the opportunity to participate in Calvin Smith’s Prayer Group and Training, the undersigned (together with the undersigned’s personal representatives, heirs, successors, assigns, and insurers, executors, administrators, spouse and next of kin, collectively referred to herein as the (‘Releaser”), ________________________________________ hereby: 1. ASSUMES ALL RISKS and responsibilities relating to, arising from, in connection with or inherent in participating in the Prayer Group and Training, including without limitation any and all physical and emotional responses and reactions relating thereto or in in connection therewith, whether spiritual, divine or otherwise, and assumes full responsibility for an risk of any Damages (defined below); and 2. EXPRESSELY WAIVES, RELEASES AND DISCHARGES Calvin Smith, Miracle Revival Center, Calvin Smith Therapy, Emerging Christians, its directors, officers, employers, employees, volunteers, agents, and the successors, assigns, affiliates, subordinates and/or subsidiaries of any of the foregoing (collectively referred to herein as the “RELEASED PARTY’) from and against any and all losses, whether physical, emotional, spiritual, divine or otherwise (including, but not limited to , property damage, bodily injury, illness or death), costs, liabilities, claims, demands, damages, actions, causes of actions or suits at law or in equity of whatsoever kind of nature, including reasonable attorney fees (collectively, “Damages”) for or because of any matter or thing done, committed or suffered to be done, by any Released Party resulting from or relating to, or to result from or relate, in any way, Calvin Smith’s Prayer Group and Training or any RELEASER, directly or indirectly, at any time or under any circumstances, including, without limitation, any Damages resulting from or relating, ANY NEGLIGENT ACT OR OMISSION ON THE PART OF ANY RELEASED PARTY, or any other person for whose acts any Released Party may in any way be liable, an any Damages caused in whole or in part by the Releaser’s own negligent act or omission which occurs while the undersigned is participating in the Prayer ministry or otherwise results therefrom or relates thereto; 3. COVENANTS NOT TO SUE the Released Party with respect to, as a result of, or in connection with any Damages for or because of any matter or thing done, committed or suffered to be done, by any Released Party resulting from or relating to , or to result from or relate to, in any way, Calvin Smith’s Prayer Group and Training or any activities or matters relating thereto, including without limitation any prayers made by or for the Releaser, directly or indirectly, at any time or under any circumstances, including, without limitation, any Damages resulting from or relating to, or to result from or relate to, ANY NEGLIGENT ACT OR OMISSION ON THE PART OF ANY RELEASED PARTY, or any other person for whose acts any Released Party may in any way be liable, an any Damages caused in whole or in part by the Releaser’s own negligent act or omission which occurs while the undersigned is participating in Calvin’s Prayer Group and Training or otherwise results therefrom or relates thereto; 4. INDEMNIFIES AN HOLDS HARMLESS the Released Party from and against any and all Damages arising from, attributable to, in connection with or because of any matter or thing done, committed or suffered to be done, by any Released Party resulting from or relating to, or to result from or relate to, in any way, or any activities or matters relating thereto, including without limitation any prayers made by or for the Releaser, directly or indirectly, Calvin Smith’s Prayer Group and Training at any time or under any circumstances, including, without limitation, any Damages resulting from or relating to, or to result from or relate to, ANY NEGLIGENT ACT OR OMISSION ON THE PART OF ANY RELEASED PARTY, or any other person for whose acts any Released Party may in any way be liable, an any Damages caused in whole or in part by the Releaser’s own negligent act or omission which occurs while the undersigned is participating in the Prayer Ministry or otherwise results therefrom or relates thereto; and 5. THE RELEASED PARTY EXPRESSLY DISCLAIMS, AND THE RELEASER HERBY EXPRESSLY WAIVES, ANY AND ALL WARRENTIES EXPRESS OR IMPLIED, OR SPIRITUAL, DIVINE OR OTHERWISE, WITH RESPECT TO CALVIN SMITH’S PRAYER GROUP AND TRAINING AND THE RELEASER’S PARTICIPATION THEREWITH, INCLUDING, WITHOUT LIMITATION, WARRANTIES OR PERFORMANCE OR RESULTS IN CONNECTION WITH ANY PRAYERS OR MINISTRY MADE BY OR FOR RELEASER, DIRECTLY OR INDIRECTLY, AND WARRANTIES OF RELEASER, DIRECTLY OR INDIRECTLY, AND WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN THIS REGARD, THE RELEASED PARTY DOES NOT WARRANT THAT PARTICIPATION IN THE PRAYER GROUP AND TRAINING WILL MEET THE RELEASERR’S EXPECTATIONS OR REQUIREMENTS, WHETHER PHYSICAL, EMOTIONAL OR OTHERWISE OR THAT ANY MINISTRY PERFORMED BY OR FOR RELEASER, DIRECTLY OR INDIRECTLY, WILL ACHIEVE ANY PARTICULAR RESULTS OR EXPECTATIONS. THE ENTIRE RISK OF THE RESULTS OR EXPECTATIONS, WHETHER REAL, IMAGINED OR OTHERWISE, OF ANY SUCH MINISTRY OR ANY OTHER MATTER IN CONNECTION WITH THE PRAYER EXPLOSION IS WITH THE RELEASER. The Releaser further agrees that this assumption of risks and responsibilities and waiver and release is signed free of any encouragement, promises or other inducements, either direct or implied, and the Releaser recognizes that access to and participation in the Prayer Ministry is at Releaser’s own risk and at the risk of no other person, firm or institution. RELEASER REPRESENTS THAT: I HAVE CAREFULLY READ THIS AGREEMENT. I UNDERSTAND IT IS A RELEASE OF ALL CLAIMS, INCLUDING THE NEGLIGENCE OF RELEASEES. I UNDERSTAND THAT I ASSUME ALL RISKS INHERENT IN CALVIN SMITH’S PRAYER GROUP AND TRAINING. I UNDERSTAD THAT I AM INDEMNIFYING THE RELEASED PARTY (AS DEFINED ABOVE).
